What Are the Insurance Rules for Uber and Other Rideshare Companies in Yorkville?

New York law requires Uber and other transportation network companies (TNCs) to maintain different levels of insurance coverage depending on the driver’s status in the app at the time of the collision.

Uber Driver Not Logged Into the App

If the Uber driver was not logged into the app at the time of the collision, the crash is generally treated like a regular car accident. The driver’s personal auto insurance policy would typically apply rather than Uber’s commercial coverage.

Because these accidents are generally treated like other New York motor vehicle collisions, no-fault insurance rules may apply. The injured person may need to satisfy New York’s serious injury threshold before pursuing certain damages beyond available no-fault benefits.

Driver Logged Into the App but Waiting for a Ride Request

When the Uber driver is logged into the app but has not accepted a passenger request, New York law requires insurance coverage of at least:

  • $75,000 for bodily injury to or death of a person,
  • $150,000 for bodily injury or death of two or more persons per accident; and
  • $25,000 for any property damage.

That coverage may come from the Uber driver’s insurance policy, a group policy maintained by Uber, or a combination of both.

Driver Traveling to Pick Up a Passenger or Transporting a Passenger

Once the Uber driver accepts a ride request, Uber’s highest level of insurance coverage generally applies. This coverage level includes situations where the driver is traveling to pick up a passenger or already transporting someone during the trip.

Under New York law, Uber must provide at least $1.25 million in liability coverage. They must also have $1.25 million in uninsured/underinsured motorist coverage.

This higher coverage exists because the driver is actively performing rideshare services at the time of the collision. These cases often involve passengers, peatones, cyclistso occupants of other vehicles who suffered serious injuries during the crash.

What Should I Do After a Yorkville Uber Accident?

The actions you take after a rideshare collision can affect both your health and your legal claim.

Call Emergency Services

Call 911 immediately after the crash. NYPD officers may respond to investigate the collision and prepare an official accident report.

Depending on the location of the crash, injured victims may receive treatment at nearby hospitals such as Lenox Hill Hospital, Mount Sinai Hospital, or NewYork-Presbyterian/Weill Cornell Medical Center.

Even injuries that seem minor immediately after the collision can worsen over time. Prompt medical treatment creates important records connecting your injuries to the accident.

Report the Accident Through the Uber App

Uber allows passengers and drivers to report crashes directly through the app. This report creates a record of the ride and may preserve information regarding the driver’s status at the time of the collision.

However, avoid making detailed statements about fault or your injuries before speaking with a Yorkville Uber accident lawyer.

Documentar la escena

If possible, gather evidence before leaving the accident scene. Helpful evidence may include:

  • Photos of vehicle damage,
  • Road conditions and traffic signals,
  • Screenshots of the Uber trip if you were a passenger,
  • Witness contact information,
  • Insurance information, and
  • The responding officer’s report number.

Traffic conditions in Yorkville can change rapidly, particularly near busy intersections and entrances to the FDR Drive. Important evidence may disappear quickly once vehicles are moved.

Avoid Speaking with Insurance Adjusters Alone

Insurance adjusters often contact injured people shortly after a crash and ask for recorded statements. The insurer may later try to use these conversations to minimize or dispute a claim. Before discussing the collision in detail, speak with an attorney who can protect your interests throughout the claims process.

Contact a Yorkville Uber Accident Lawyer

Uber accident claims often involve complicated insurance issues and multiple parties. Speaking with an attorney early can help protect your rights and prevent insurance companies from minimizing your claim.

How Long Do I Have to Bring a Yorkville Accident Claim?

New York generally allows injured people tres años from the date of a motor vehicle collision to file a personal injury lawsuit. Wrongful death claims are typically subject to a dos años fecha límite.

Although that may seem like plenty of time, waiting too long can seriously damage your case. Evidence in Manhattan rideshare accidents can disappear quickly.

Surveillance footage from nearby buildings or traffic cameras may be erased, witnesses may become difficult to locate, and insurance companies immediately begin building defenses after a crash.

Certain situations may involve shorter deadlines, especially when government entities or public vehicles are involved.

Involving an attorney from the beginning allows your legal team to preserve evidence, investigate the crash, and protect your right to pursue compensation.

What If I Was Partially Responsible for the Yorkville Accident?

Passengers are rarely assigned fault for a rideshare collision, but comparative negligence issues may arise for drivers, cyclists, pedestrians, or others involved in the crash.

New York follows a pure comparative negligence rule. Under this rule, even if you share some responsibility, you may still recover damages. However, your percentage of fault may reduce your compensation proportionately.

Insurance companies often use comparative negligence arguments to reduce payouts after rideshare crashes. Our attorneys work to challenge unfair blame-shifting tactics and present evidence in support of our clients’ claims.
