No one goes into a medical facility in New Jersey expecting one procedure but ends up with another. That very issue happened to a man who was set to undergo a circumcision but received a vasectomy instead.

What Happened?

A man in his early 40s was scheduled to have a circumcision at a clinic in Iowa. Although he is a father of three, he had plans to have more children. That ended up no longer being possible because instead of the procedure he was expecting, he later came to realize that the doctor performed a vasectomy. The news was devastating for him.

Jury Awards the Man Damages for Medical Malpractice

The situation resulted in the man filing a medical malpractice lawsuit. The doctor and staff at the clinic where the procedure was performed seemed uncaring about the mistake. The jury understood the victim’s pain and granted him damages in the case. However, it also determined that he was 30% responsible due to miscommunication. The man did not speak English, so it’s believed that the doctor misinterpreted that he wanted a circumcision and not a vasectomy.

The mistake wasn’t realized until after the man came back for a follow-up after his surgery. It was then that he decided to file the medical malpractice lawsuit against the doctor and the clinic itself. An interpreter service he used also ended up being sued but wasn’t found liable.

The victim received $1.4 million in damages and the clinic filed an appeal. The appeal was later denied. The man’s attorney explained that because he doesn’t speak English, four interpreters translated everything on written informed consent documents from the clinic. He said that the clinic blamed his client for having the vasectomy and for not stopping the procedure from occurring.
