What Are the Insurance Rules for Uber and Other Rideshare Companies in Yorkville?

New York law requires Uber and other transportation network companies (TNCs) to maintain different levels of insurance coverage depending on the driver’s status in the app at the time of the collision.

Uber Driver Not Logged Into the App

If the Uber driver was not logged into the app at the time of the collision, the crash is generally treated like a regular car accident. The driver’s personal auto insurance policy would typically apply rather than Uber’s commercial coverage.

Because these accidents are generally treated like other New York motor vehicle collisions, no-fault insurance rules may apply. The injured person may need to satisfy New York’s serious injury threshold before pursuing certain damages beyond available no-fault benefits. 

Driver Logged Into the App but Waiting for a Ride Request

When the Uber driver is logged into the app but has not accepted a passenger request, New York law requires insurance coverage of at least:

  • $75,000 for bodily injury to or death of a person,
  • $150,000 for bodily injury or death of two or more persons per accident; and
  • $25,000 for any property damage.
